Letter to the Residents

 

Overview

We have taken over the responsibility as promised to maintain the entranceway.    The gazebo will not be painted as it is treated lumber and it should blend very nicely into the décor of the community.  Running water is available for not only watering the bushes and plants but also for use by the residents during parties. 

We have been asked by a resident, who is responsible for utility lines, pipe, and systems.  Let us point out to all of you that in the Declaration of Condominium for Evergreen Village Association, Article II, Allocation of Percentage Interests, Votes and Common Expense Liabilities; Unit Identification and Boundaries; Maintenance Responsibilities, Section 2.3, c. (2) it states that a unit owners is responsible for utility pipe and lines of service serving only one unit.  Therefore, as an example, the water line from the meter to your unit is your responsibility if it is in need of repair.  The same goes for the air conditioning condenser, gas line, etc.  Some of you may want to consider the insurance policies offered by utility companies relative to this issue.

Grounds Committee

The Grounds Committee and the Executive Board of EVCA felt that we should try to clarify our policy towards the grounds in our community.

All of the areas outside the walls of your unit are defined as Limited Common Areas or Common Areas according to the Declaration/By-Laws that you agreed to, when purchasing your residence. These areas are under the control of the EVCA Executive Board and the Building Committee not an individual resident or unit owner.

Limited Common Area is defined as, property bordering your immediate residence and/or patio.  Common Areas are all other property within EVCA’s borders. Typically, grassy areas around your unit are Common Areas.

We need to clarify the responsibilities of the Association versus the Unit owner.

The Executive Board has ruled that the trees and bushes that are in place now should remain with the following stipulations.

 

  1. All new plantings in the Limited Common Areas require a Change Order, filed according to the regulations and must be reviewed by the Grounds Committee and approved by the Executive Board of EVCA prior to any work being started.
  2. The approved plans for the development stipulates the variety of plants at each unit as follows: This means that each type is a combination of the varieties indicated and the number is the maximum for that type.

It is important to point out that additional species may be added to this list from time to time.

 

  1. These are the plantings the EVCA will replace if they die or become unsuitable at the discretion of the Executive Board through recommendations from the Grounds Committee and within the available budget and assuming that the builder’s warranty period has expired. Remember, plants die without water. Please water.
  2. Any additional plantings around your unit (Limited Common areas) will not be replaced by the EVCA but are your responsibility to replace in kind. Any changes require an approved Change Request prior to the work starting.
  3. Pruning is permitted in the Limited Common areas by the residents. It is important to point out however, that if this results in the plant failing then the EVCA will not be responsible for replacement.
  4. No pruning in the Common Areas is ever permitted by residents (i.e. Cleveland Pear trees along roadways, Evergreens bordering the Canonsburg Lake).
  5. All other Evergreens or trees not on the Border with Canonsburg Lake are not the responsibility of the EVCA.
  6. Fertilization, or any other treatment of the grass is done under contract and is never to be done by residents; any violation of this rule will result in not only a fine but also a charge for any repairs incurred by EVCA.
  7. In order to preserve our property values we ask that the residents water their areas.
  8.  Plantings behind a fence are the sole responsibility of the resident but as stated in number 1 above, any change requires a Change Order (excluding the planting of annuals, copy of this form is available on our web site at http://evergreen15317.org.
  9. We encourage the residents to continue to make our condominium as beautiful as possible with a rich mix of approved plants. Annuals may be planted in residents Limited Common Area without a change order, however planting, care and maintenance and removal are the sole responsibility of the resident.
  10. All requests and issues should be handled through the Management Company (ACRI @ 412.459.0111) so that they are handled in a proper fashion. Each request will be forwarded to the proper committee in EVCA for their recommendation and then approved or rejected by the Board.
  11. Plants, bushes and trees not on the approved plan (above) will be handled on a case by case basis.

Pets

We would like to once again remind the members that as stated in the Declaration of Condominium For Evergreen Village Association, Article VI, 6.1 h

“All pets must be kept leashed when outside the Unit. No pets may be left outside the Unit unattended in a kennel run or in any fashion”. Failure to comply with this rule may result in fine. Please remember the Common Area is typically the grassy areas around each unit. This area belong to all of us (please read the Grounds section for more info on Limited Common and Common Areas
